Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 25 of the Equal Status Act, 2000,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint.
Background:
The complainant submitted a complaint under the Equal Status Act 2000 which was received by the Workplace Relations Commission on 16th September 2021. |
Summary of Complainant’s Case:
The complainant did not attend the hearing which was scheduled for 10am in the Workplace Relations Commission Hearing Rooms in Carlow on 21st December 2022. I deferred the commencement of the hearing until 10.15 to allow the complainant to attend. |
Summary of Respondent’s Case:
The respondent and their representative attended the hearing to answer the complaint. |
Findings and Conclusions:
Having checked after the hearing, I am satisfied that the complainant was on notice of the scheduled hearing time, date, and venue. As the complainant did not attend and no complaint was made out, I find that the complaint is not well founded, and that the respondent did not engage in prohibited conduct under the Equal Status Act. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
