Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.

Background:

The Worker is employed as a general operative for the Respondent company. The Worker referred a dispute to the Workplace Relations Commission on 15th November 2021.

Summary of Worker’s Case:

The Worker did not attend the hearing.

Summary of Employer’s Case:

The Employer did not attend the hearing.

Findings and Conclusions:

The dispute was received by the Director General of the Workplace Relations Commission on 15th November 2021. The complaint was assigned the complaint application number CA-00047187-001.

The said complaint was referred to me for investigation. A hearing for that purpose was arranged for 22nd September 2022.

No appearance was entered by or on behalf of the Worker.

No appearance was entered by or on behalf of the Employer.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the dispute in accordance with the relevant redress provisions under Schedule 6 of that Act.

Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.

I do not recommend in favour of the Worker.
