Procedure:
On the 18th January 2022, the complainant submitted a complaint pursuant to the Payment of Wages Act. The complaint was scheduled for hearing on the 24th August 2022.
The complainant attended the hearing. There was no attendance by or on behalf of the respondent. I verified that the respondent was on notice of the time, date and venue of the hearing. I waited some time to accommodate a late arrival. Having taken these steps and the respondent did not attend, I proceeded with the hearing in the absence of the respondent.
In accordance with section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant outlined that he worked for the respondent and was not paid €580 for tiling work done. The complainant confirmed the company name of the respondent. |
Summary of Respondent’s Case:
The respondent did not deny that it owed €580 to the complainant. |
Findings and Conclusions:
The complainant gave a cogent account of being owed €580. This was not contradicted by the respondent. I therefore find that the complainant is owed €580 in unpaid wages. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
CA-00048184-001 I decide that the complaint pursuant to the Payment of Wages Act is well-founded and the respondent shall pay to the complainant compensation of €580. |
