Procedure:
On the 7th January 2022, the complainant submitted a complaint pursuant to the Payment of Wages Act. It was scheduled for hearing on the 7th September 2022.
It was apparent at the time the hearing was to commence that there was no attendance by or on behalf of the complainant. I verified that the complainant was served the details of the time, date and venue of the hearing. Having taken this step and waited for a delayed arrival, I proceeded with the hearing in the absence of the complainant. The respondent attended the hearing.
In accordance with section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The complainant did not attend the hearing to advance the basis of any contravention of the Payment of Wages Act. |

The respondent attended the hearing to meet the claim. |
Findings and Conclusions:
As the complainant did not attend the hearing to advance the basis of any contravention of the Payment of Wages Act, I find that there was no contravention of the Payment of Wages Act. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
