Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 | CA-00050176-001 | 03/05/2022 |
Date of Adjudication Hearing: 06/01/2023
Workplace Relations Commission Adjudication Officer: Brian Dalton
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
A hearing was arranged to hear the complaint: I worked for this agency (The HR Specialists Limited) when I arrived in Ireland doing some freelancer jobs as waiter. The problem is that the company never submited my payrolls to the Revenue, so now that I want to cease this company on my Revenue I can't do that, otherwise I could never receive my emergencial taxes from this company (around 328 euros). |
Summary of Complainant’s Case:
The Complainant failed to attend at the hearing. |
Summary of Respondent’s Case:
The Respondent failed to attend at the hearing. |
Findings and Conclusions:
I am satisfied that the Complainant was notified of the date, time and venue of the hearing by post on the 17th of November 2022. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
As the Complainant has failed to attend at the hearing having been notified of the date, time and venue of hearing I find that the complaint is not well founded. |
