Procedure:
This complaint was submitted to the WRC on May 18th 2022 and, in accordance with Section 8 of the Unfair Dismissals Act 1977 – 2015, it was assigned to me by the Director General. A hearing was arranged for December 14th 2022 at 11.30am, for the parties to present evidence in respect of the complaint. An interpreter was booked and ready to assist Mr Bamidele, but neither he or his solicitor attended the hearing. When the case officer phoned Mr Bamidele’s solicitor, there was no answer. No one attended from Synergy Security Solutions and the company was not represented.
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
In the circumstances where the parties did not attend the hearing and, in the absence of any evidence to the contrary having been adduced before me, I must conclude that this complaint under the Unfair Dismissals Act 1977 – 2015 is not well-founded and I decide accordingly. |
