Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant applied for a position with the Respondent on or about 21st May 2022 and was unsuccessful in that application. This complaint is made under the ground of religious discrimination. The Complainant stated on his form that: “I have selected that the basis of the Discrimination, which I note has been widely government backed, is on religious grounds due to the fact of my close association with the spiritual workings of the universe we are living in.”

Findings and Conclusions:
I am satisfied that the defendant was notified of the place, date and time of the hearing and failed to attend. The exceptional reason has been provided to explain the non-attendance at the hearing. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I determine that the Complainant was not discriminated against on the ground of religion, and I dismiss the case. The Respondent attended the hearing and was ready to rebut the allegations made by the Complainant. The Complainant failed to attend at the hearing and to present their case. In these circumstances the complaint of discrimination must fail. |
