Date of Adjudication Hearing: 20/06/2023
Workplace Relations Commission Adjudication Officer: Thomas O'Driscoll
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints. The Complainant did not attend the hearing. The Respondent was in attendance.
Background:
The Complainant submitted complaints under the Terms of Employment (Information) Act 1994 and the Minimum Notice and Terms of Employment Act 1973. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing. |
Summary of Respondent’s Case:
The Respondent attended the hearing, but no evidence nor submission was requested by me on the day due to the non-attendance of the Complainant. |
Findings and Conclusions:
The Complainant did not attend the hearing on the day, and I am reasonably satisfied that he had notice of the time, date, and venue of the hearing. I find that his complaints were not well founded due to a lack of evidence. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
