Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard and to present any information relevant to the dispute. The hearing was held in the Workplace Relations Commission (WRC) Hearing Rooms in Carlow on the above date.
Ms Kelly BL appeared on behalf of the worker and sought an adjournment due to the unavailability of the worker due to illness. Ms Mc Guinness BL and the employer were in attendance. The hearing was adjourned for a period to decide on the adjournment request.
On the resumption of the hearing, I decided not to grant the adjournment on the basis that no medical certificate was presented, and no submissions had been made in advance of the hearing.

Conclusions:
As the worker did not attend the hearing to set out the basis of his dispute, I find no merit in the dispute and recommend that the dispute is not well founded. |

Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
