Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 13 of theIndustrial Relations Acts 1969 following the referral of the complaint/dispute to me by the Director General, I inquired into the complaint/dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint/dispute.
Background:
This dispute was referred as an Injury at Work scheme (IAW) benefit had been withdrawn from the Worker.
Summary of Worker’s Case:
The Worker sustained an injury at work (electric shock) in 2020. She had been given the benefit of the IAW scheme until July 2021 when it was withdrawn. This was because in error, the Worker submitted a medical certificate citing a different medical condition. The employer has agreed to re-instate the IAW payment and the matter is resolved.
Summary of Employer’s Case:
The Employer confirms that the matter is fully resolved and that payment will be re-instated from 24 April 2023 and backdated to the date in July 2021 when it was withdrawn.
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
As the dispute has been confirmed by both parties to have been resolved, I make no further recommendation on this matter.
