Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015, and Section 79 of the Employment Equality Acts, 1998 - 2015, and Section 25 of the Equal Status Act, 2000 and following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Preliminary Application:
The Respondent: The Respondent argues that all of the Complaints are statute barred. However, it is conceding CA 00051651 -003, 007, 010. The Respondent is not contesting the three claims arising out of the non-payment of the Complainant’s wages, in spite of the fact that those claims are statute barred and re-confirms that it is happy to discharge the sum of €965.20 to the Complainant as soon as she provides her bank details. The Respondent has been attempting to discharge that sum to the Complainant for almost a year.
Ms. Karla Farrell following the Affirmation gave evidence as follows: The Complainant lodged her complaints on 7th July 2022. That date falls six months and one day after the Complainant’s resignation on 6th January 2022. The Complainant sent a “WhatsApp message to Ms O’ Farrell on the 6th January stating “Hey Karla due to social welfare stopping payment I’ve no means of continuing employment as they think I’ve being paid yet I stated I haven’t received Any wage I will not be returning can you forward me work day app to get the two weeks that I’m owed sorry………….”. She did not work after that. Ms Farrell replied “ Hi Sonia, sorry to hear that, workday instructions were sent to your email, you will need to activate it and set up your bank details before the 10th to make sure you are paid and you will also need to follow up with an email” That was a Thursday. Correspondence was received by the Respondent after the 6th January but same was in relation to payment. Therefore, all the Complainant’s claims which are subject to the six-month limitation period in s.41(6) of the Workplace Relations Act, 2015, are statute barred.
The Complainant: Following the Affirmation, the Complainant gave her evidence as follows: She did send the text message referred to by the Respondent on the 6th January. That was a Thursday. She did work after that though. It might have been the 8th or the 9th or maybe the 10th but she did work after that. She sent a text to Ms O’ Farrell on the 10th which is proof that she worked. It stated “Karla I still haven’t received workday, I received an email from taco UK, Please forward work so that I can get paid. I wasn’t aware of the difficulty in trying to get out Dyson. There seems to be an intrusion in employee email from employee and the lack of communication wages I was told I was to be paid weekly by Alison. It really doesn’t matter but I need to get paid and this is the second request, thank you “ A second message was sent, and it says “Ok, I got your email re process contract. Will do, sorry about all this thanks”. The Complainant states that she is fully aware of the 6 months rule and knows she left it to the last minute but would absolutely not have filed the complaints outside of the six months.

Findings and Conclusions:
Having considered the evidence of Ms. O’ Farrell and Ms. Francis as set out above together with the documents submitted by the parties, I am satisfied that the Complainant did resign from her position on the 6th January 2022. The text message sent to Ms O’ Farrell stated “Hey Karla due to social welfare stopping payment I’ve no means of continuing employment as they think I’ve being paid yet I stated I haven’t received any wages. I will not be returning, can you forward me work day app to get the two weeks that I’m owed sorry” The Respondent relies on the case of Shinkwin v Millett EED044 wherein the labour Court held: “Resignation is a unilateral act which if expressed in unambiguous and unconditional terms, brings a contract of employment to an end”. The two text messages relied on by the Complainant do not support her evidence that she worked after the 6th January. Those messages were clearly in relation to payment. Furthermore, she was unable to give any specific information as to what day, date, place or time that she worked after the 6th. I am fully satisfied that the date of termination of her employment was 6th January 2022. No application was made, and no evidence was adduced that could allow me to consider extending the time limits pursuant to Section 41(8). S41 (6) “Subject to subsection (8), an adjudication officer shall not entertain a complaint referred to him or her under this section if it has been presented to the Director General after the expiration of the period of 6 months beginning on the date of the contravention to which the complaint relates” The Complainant’s employment ended on the 6th January 2022. That is the date of the contravention to which the complaints relate. She filed her 43 complaints on the 7th July 2022, six months and one day later. The Complainant stated that she was fully aware of the six month time limit. It is irrelevant how many days the complaint is over the time limit, one day or one hundred days, has the same effect on my jurisdiction to hear the complaints. I am satisfied that the complaints were filed outside of the six months provided for in the Act and therefore I find that I do not have jurisdiction to hear them. Despite the fact that I do not have jurisdiction to hear any of the Complaints, I do note that the Respondent has conceded claim CA 51651 03, 07,10 and states that it is willing to pay to the complainant the sum of €965.20. Whilst I note that those claims are conceded I do not have jurisdiction pursuant to S41(6) to make a decision on those claims. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the
Complaints CA 51651 – 001, 002,003,004,007, 008, 009, 010, 013,014,015, 016, 017, 020, 021, 022, 023, 025, 026, 027, 028, 029, 030, 031, 032, 033, 034, 035, 036, 037,038,39, 040,041, 042, 043 are statute barred and accordingly fail. |

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
