Procedure:
In accordance with Section 41 of the Workplace Relations Act 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complaint was received by the Workplace Relations Commission on the 3rd October 2022. The Commission notified the Respondent and enclosed copy of the complaint on the 29th November 2022. A hearing was scheduled for the 17th April 2023. There was no attendance at the hearing by, or on behalf of, the Complainant or the Respondent. No communication was received by either party to give a reason for their non-attendance. |

Findings and Conclusions:
A complaint pursuant to the Payment of Wages Act 1991 was received by the Workplace Relations Commission on the 3rd October 2022. The said complaint was referred to me for investigation. A hearing for that purpose was arranged for the 17th April 2023. There was no attendance by either party at the hearing. I am satisfied that the parties were informed in writing of the date, time and place at which the hearing to investigate the complaint would be held. In the circumstances and in the absence of direct evidence, I must conclude that the complaint is not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons given above, I find that the complaint is not well-founded and I decide accordingly. |
