Procedure:
The worker submitted a complaint and dispute for adjudication by the Workplace Relations Commission. I addressed the complaint in employment rights decision, issued by separate cover. This recommendation relates to the balance of the dispute, the industrial relations referral.
In accordance with section 13 of the Industrial Relations Act 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Summary of Workers Case:
Amongst other issues, the worker outlined that the respondent had failed to investigate his complaint of bullying at work. |
Summary of Employer’s Case:
The employer did not accept that the worker had engaged its bullying procedure. |
Conclusions:
I find that the worker did make a bullying complaint, which was not addressed by the employer and ought to have been. I recommend that the employer implement a bullying procedure in line with the Code of Practice for Employers and Employees on the Prevent and Resolution of Bullying at Work (SI 674/2020). Financial redress and more detailed findings are set out in the employment rights decision. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
