Procedure:
On the 5th June 2022, the worker referred a dispute to the Workplace Relations Commission pursuant to section 13 of the Industrial Relations Act. It was scheduled for adjudication on the 2nd May 2023.
There was no appearance by or on behalf of the worker at the time the adjudication was scheduled to commence. The employer was in attendance and represented by David Nohilly, solicitor.
I verified that the worker had been served with notice of the time, date and venue of the adjudication. I waited some time to accommodate a late arrival. There was no appearance by the worker. I, therefore, proceeded with the hearing in the absence of the worker.
In accordance with section 13 of the Industrial Relations Act 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.

The employer was present to meet the worker’s dispute. |
Conclusions:
As the worker did not set out the merits of his claim, I cannot make a recommendation in the worker’s favour. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
