1.Complaint Under Section 20(1) Of The Industrial Relations Act 1969

BACKGROUND:

2.This dispute concerns a complaint in relation to treatment by the Employer. The Worker referred this case to the Labour Court on 8 March 2023 in accordance with Section 20 (1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court’s Recommendation. A Labour Court hearing took place on 2 June 2023.

RECOMMENDATION:

The Court is not satisfied that the issues which gave rise to the referral of this matter for its consideration can be regarded as meeting the definition of a trade dispute, as set out in s.8 of the Industrial Relations Act 1990, which reads as follows;

“Trade dispute” means any dispute between employers and workers which is connected with the employment or non-employment, or the terms or conditions of or affecting the employment, of any person;

Accordingly, the Court makes no recommendation.
