Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969following the referral of the complaint to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Specifically, I conducted a remote hearing in accordance with the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and Statutory Instrument 359/2020 which designates the Workplace Relations Commission as a body empowered to hold remote hearings.
The Worker did not attend the hearing to give evidence. The Employer was present along with their representative.
Background:
In his complaint form, the Worker stated that he was engaged by the Employer as a Finance Manager on 29 April 2021 and was paid €1,154 per week. He alleged that he was unfairly dismissed on 24 August 2021 when he was accused of sending incorrect information to the Board of the Employer. |
Summary of Worker’s Case:
The Worker did not attend the hearing to give evidence. |
Summary of Employer’s Case:
The Employer was in attendance along with their representative but did not give evidence as the Worker failed to present his complaint. |
Findings and Conclusions:
Given the failure of the Worker to attend on the day of the hearing, I cannot make a recommendation in relation to this dispute |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
I cannot make a recommendation in relation to this dispute for the reasons set out above. |
