Procedure:
On the 5th June 2022, the complainant referred complaints to the Workplace Relations Commission. They were scheduled for adjudication on the 2nd May 2023.
There was no appearance by or on behalf of the complainant at the time the adjudication was scheduled to commence. The respondent was in attendance and represented by David Nohilly, solicitor.
I verified that the complainant had been served with notice of the time, date and venue of the adjudication. I waited some time to accommodate a late arrival. There was no appearance by the complainant. I, therefore, proceeded with the hearing in the absence of the complainant.
In accordance with section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The respondent was in attendance to meet the complaints. |
Findings and Conclusions:
As the complainant did not attend the hearing and did not give evidence to substantiate the complaints, I find that the complainant has not established that any contravention occurred. |
Decisions:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
