Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Background:

The Employee submitted a dispute about the procedure used to assess her sick pay complaint and that it did not comply with the Employer procedure or was fair.

Findings and Conclusions:

A Complaint was received by the Director General of the Workplace Relations Commission by the Complainant on August 8th 2022 stating the Employee had a dispute with the Employer. The said dispute was referred to me for investigation. A Hearing for that purpose was held on April 18th 2023. There was no appearance by or on behalf of the Complainant at the Hearing. I am satisfied that the said Complainant was informed in writing of the date, time and place at which the Hearing to investigate the dispute would be held and were not present at the Hearing.

The Employer submitted a detailed rebuttal of the complaint in advance of the Hearing and attended the Hearing. The Employer denied the compliant was valid.

Recommendation:

Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.

I find in favour of the Employer.
