Date of Adjudication Hearing: 06/04/2023
Workplace Relations Commission Adjudication Officer: Breiffni O'Neill
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The complaint was identical to that made in ADJ-00040254 and this should be read in conjunction with that decision.
Despite having been notified of the time and date of the hearing, the Complainant did not attend to give evidence. The Respondent’s representative was in attendance on the day along with two witnesses from the company.
Background:
In the complaint form submitted to the WRC, the Complainant stated that she did not receive payment of a bonus that she alleged was due to her. The Respondent denied that the bonus was payable as the Complaint had left her employment before the bonus was payable, namely at the end of the contract. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing to give evidence. |
Summary of Respondent’s Case:
As the Complainant did not attend the hearing to give evidence. |
Findings and Conclusions:
In the absence of any evidence having been presented, I must conclude that the within complaint is not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is not well founded for the reasons set out above. |
