Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 6 of the Payment of Wages Act following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The claimant was employed as a General Operative with the respondent from the 8th.April2022 to the 12th.May 2022.She submitted the respondent was in breach of the Act for failing to pay her outstanding wages and holiday pay amounting to €430.10.The respondent did not attend and was not represented at the hearing.

Summary of Complainant’s Case:
The complainant worked for the respondent from the 8th.April 2022 to the 12th.May 2022.During that period she was paid for 8 days only and did not receive holiday pay.She estimated that she was owed 46 hours in wages for pay and holiday pay – amounting to €431.10.The claimant tried to resolve the matter directly with the respondent who reassured her that his Financial Adviser would be in touch but to date he had failed to respond. |

Based on the uncontested evidence of the complainant I am upholding the complaint . |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section of the Payment of Wages Act 1991 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
I require the respondent to pay the complainant compensation of €430.10 |
