Date of Adjudication Hearing: 27.6.2022; 19.12.2022; 14.11.23
Workplace Relations Commission Adjudication Officer: Emile Daly
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
No appearance on behalf of the Complainant at the Adjudication hearing |
Summary of Complainant’s Case:
No appearance on behalf of the Complainant at the Adjudication hearing |
Summary of Respondent’s Case:
The Respondent is in liquidation and the Liquidator does not contest the evidence given by the Complainant. |
Findings and Conclusions:
As there was no appearance at the Adjudication hearing on 14 November 2023, no sworn evidence on behalf of the Complainant was given. As the onus is on the Complainant to prove each complaint and the Complainant did not attend the hearing, this onus was not discharged and there can be no decision made in the Complainant’s favour. I find these complaints to be not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Each of these complaints are not well founded |
