Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 21 Equal Status Act, 2000 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
1: Non-Appearance of Complainant
The Complainant did not attend the Oral hearing on the 29th September 2023. He was fully notified of the time ,date and place of the Hearing.
No satisfactory Bona Fide explanation for the Non Appearance was received by the Workplace Relations Commission, in a reasonable period, following the Hearing.
2: Findings and Conclusions:
The Complainant did not attend despite being properly notified of the date ,time and place of the Hearing. No bona fide explanation for non-attendance was received post the Hearing. As no evidence was advanced for consideration by the Adjudication Officer and cross examination by the Respondent the case is deemed Not Well Founded and is dismissed. The Complaint fails. |
3: Decision:

Section 41 of the Workplace Relations Act 2015 and Section 21 Equal Status Act, 2000 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions of the cited Acts.
The case is dismissed as not Well Founded.
The complaint fails.
