Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute. The worker did not attend the hearing. The hearing was heard remotely pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. 359/2020, which designated the Workplace Relations Commission as a body empowered to hold remote hearings.

Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
A dispute was received by the Director General of the Workplace Relations Commission from the complainant on 22/06/2023. The said dispute was referred to me for investigation. A hearing for that purpose was held on 03/11/2023 and there was no appearance by the worker. The employer attended the hearing and refuted the claims. I am satisfied that the said worker was informed in writing of the date, time and place at which the hearing to investigate the complaint would be held and did not attend.
In all the circumstances, I find there is no merit in the dispute and I dismiss the dispute. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
