Procedure:
This complaint was submitted to the WRC on July 3rd 2023 and, in accordance with Section 41 of the Workplace Relations Act, it was assigned to me by the Director General. A hearing was arranged for Friday, October 27th 2023 at 9.30am, for the parties to present evidence in respect of the complaint; however, neither the complainant or the respondent attended at the appointed time. Having checked the case file, I noted that, on July 25th 2023, the respondent sent a written response to the complaint and that, on September 13th, both parties were properly notified of the time and date of the hearing. By 10.00am on October 27th, when neither party was present, and, with no contact regarding an explanation for not attending, I reached the decision set out below.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances in which the complainant and the respondent did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that this complaint is not well founded and I decide accordingly. |
