Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
This is a dispute brought by a worker against her Employer who owns a Retail business. |
Summary of Workers Case:
There was no appearance at Adjudication hearing by the Worker and no submission was filed by the Worker in advance of the hearing and the Worker did not engage with WRC correspondence in advance of the Adjudication hearing and no postponement was sought. |
Summary of Employer’s Case:
The Employer attended the Adjudication hearing on 22 November 2023, having filed a written submission which denied the complaint in full. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
As there was no attendance at the Adjudication hearing on 22 November 2023 and being satisfied that the Worker was on notice of the remote hearing by way of WRC notification, because this dispute was not proceeded with by the Worker, I find it is not well founded. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I find this dispute to be not well founded.
