Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 | CA-00053371-001 | 21/10/2022 |
Date of Adjudication Hearing: 23/05/2023
Workplace Relations Commission Adjudication Officer: Caroline Reidy
Procedure:
In accordance with Section 6 of the Payment of Wages Act 1991 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Complainant, Natalia Orlova stated she was owed salary of €1,500 for more than 2 month’s work and submitted her case to the WRC for hearing.
|
Summary of Complainant’s Case:
The Complainant did not attend the hearing. On 6 April 2024 the Complainant was issued with letter via email outlining date of hearing. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing. On 6 April 2024 the Respondent was issued with letter via post outlining date of hearing. |
Findings and Conclusions:
I am happy that both parties were correctly notified and as both parties did not attend the hearing so the claim fails as the complainant did not attend to give evidence to support her case and facilitate cross examination of her evidence. |
Decision:
Section 6 of the Payment of Wages Act 1991 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
I find that the Complainant and Respondent were correctly notified but did not attend the hearing therefore the claim is not upheld. |
