Procedure:
This complaint was submitted to the WRC on October 13th 2022 and, in accordance with Section 41 of the Workplace Relations Act, it was assigned to me by the Director General. A hearing was arranged for Monday, October 2nd 2023 at 9.30am, for the parties to present evidence in respect of the complaint; however, neither the complainant nor the respondent attended at the appointed time. Having checked the case file, I established that both parties were properly on notice of the hearing. By 10.00am, with neither party present, and, with no contact regarding an explanation for not attending, I reached the decision set out below.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances in which the complainant and the respondent did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that this complaint is not well founded, and I decide accordingly. |
