Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. No. 359/2020 which designates the WRC as a body empowered to hold remote hearings. The complainant gave her evidence under affirmation. The matter was settled at the first hearing and time was given to perfect the settlement. The complainant indicated that matters had not settled to her satisfaction and sought a second hearing. As the complainant indicated that matters were not settled, a second hearing was reconvened. The respondent did not attend the second hearing of this matter. |
Summary of Complainant’s Case:
At the start of the second hearing, the complainant confirmed that she had received a cheque covering the outstanding pay and had cashed the cheque. She submitted that she was not happy with the manner of the settlement and sought a hearing on the matters. |
Summary of Respondent’s Case:
The respondent did not attend the second hearing on this matter. |
Findings and Conclusions:
At that hearing the complainant confirmed that she had received a cheque covering the outstanding pay. She confirmed that she had cashed this cheque. In the circumstances I find that payment of wages has been made and the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Having regard to all the written and oral evidence before me, my decision is that the complaint is not well founded. |
