Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 andSection 8 of the UnfairDismissals Acts, 1977 – 2015 and Section 79 of the Employment Equality Acts, 1998 - 2015following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
The Complainant submitted a manual form on 04.11.2022 listing several complaints selected from the WRC form and as set out above against the various CA numbers. A virtual hearing was scheduled for April 28th 2023 at 10 am. The host for the hearing endeavored to send the necessary links and made contact with the parties for that purpose. On April 25th he was party to a conversation involving another member of staff where the Complainant said that she was withdrawing her complaints. She was asked to confirm this in writing but failed to do so. A link for the hearing was issued to her by email but this ‘bounced back’ as undelivered. The Complainant did not attend for the hearing. Also on April 25th, the host spoke to the named Respondent who said that he should not have been named as the Respondent and that he had previously sent an email to PRU at the WRC to this effect-that email is not recorded on the file as received. The link for the hearing was issued to the Respondent but he did not attend.

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
CA-00052723-001-006 and CA-00052723-008-028 and CA-00052723-0030 As evidence to support these complaints was not presented by or on behalf of the Complainant at the hearing scheduled by the WRC for the purpose of inquiring into the matters complained of, I find that the complaints as enumerated are not well founded and/or are dismissed as the case may be in accordance with the relevant provisions of the legislation under which the complaints were made. |
