Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complaint From was received by the Workplace Relations Commission on 17 January 2023

The Complainant appeared in person with the assistance of Mr Murphy.

Summary of Complainant’s Case:

The Complainant submitted that he was owed a total of €719.69 in unpaid wages.

He commenced employment on 26 October 2021 and ended his employment on 18 November 2022.

The Complainant confirmed that he has not been paid this sum since the date his complaint form was submitted to the WRC.

Summary of Respondent’s Case:

Having reviewed the file I am satisfied that the Respondent was on notice of the hearing. There was correspondence from the Managing Director of the Respondent to the Workplace Relations Commission dated 23 February 2023.

Findings and Conclusions:

I waited a reasonable period of time for the Respondent to attend but there was no appearance. The hearing proceeded in its absence.

On the basis of the uncontested evidence of the Complainant, I find that his complaint is well founded and award him €719.69 being the sum of the unpaid wages.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
