Workplace Relations Commission Adjudication Officer: Seamus Clinton
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard and to present any evidence relevant to the complaints. The hearing was held in the Hearing Rooms, Workplace Relations Commission (WRC), Carlow. Neither the complainant nor respondent attended the hearing.
Background:
The complainant did not attend the hearing to make out her complaints. I am satisfied that the complainant was on notice of the scheduled hearing. |
Summary of Complainant’s Case:
The complainant did not attend the hearing to give evidence and no complaints were made out under the relevant Acts. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. |
Findings and Conclusions:
As the complainant did not attend the hearing to give evidence, I find that the complaints are not well founded. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
CA-00055125-001 As the complainant has not advanced any evidence of an unfair dismissal, I find that the complainant was not unfairly dismissed. CA-00055125-002 I decide that the complainant has not advanced any evidence regarding any contravention and therefore the complaint is not well founded. |
