Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The Worker referred a dispute under the Act that he was penalised by the Employer by having his hours cut.
Summary of Workers Case:
The Worker did not attend to put forward his case.
Summary of Employer’s Case:
The Employer and representatives attended the hearing and had made a detailed submission in advance of the hearing outlining their response.
Conclusions:
Having been notified of the time, date and venue for the hearing convened to consider his dispute with the Employer, the Worker did not attend or provide an explanation for his absence.
In light of the lack of his attendance, I conclude that no recommendation can be made.
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute. In the absence of the Worker to explain his case, I can make no recommendation in relation to this dispute.
