Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
The worker submitted a manual form on 05.09.22 listing several complaints selected from the WRC form and as set out above against the various CA numbers. A dispute under the Industrial Relations Act 1969 was also listed. A virtual hearing was scheduled for April 28th, 2023, at 10 am. The host for the hearing endeavored to send the necessary links and made contact with the parties for that purpose. On April 25th he was party to a conversation involving another member of staff where the worker said that she was withdrawing her complaints/dispute. She was asked to confirm this in writing but failed to do so. A link for the hearing was issued to her by email but this ‘bounced back’ as undelivered. The worker did not attend for the hearing. Also on April 25th, the host spoke to the named Respondent who said that he should not have been named as the Respondent and that he had previously sent an email to PRU at the WRC to this effect-that email is not recorded on the file as received. The link for the hearing was issued to the Respondent but he did not attend.
