Complaint seeking adjudication by the Workplace Relations Commission under section 77 of the Employment Equality Act, 1998 | CA-00054390-001 | 07/01/2023 |
Date of Adjudication Hearing: 05/03/2024
Workplace Relations Commission Adjudication Officer: Breiffni O'Neill
Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Although I am satisfied that the Complainant was on notice of the time and date of the hearing, he did not attend to give evidence. The Respondent was in attendance along with their representative.
Background:
The Complainant commenced his employment with a client of the Respondent on 7 February 2022. He stated that he was discriminated against on the grounds of his gender, sexual orientation and age when the client of the Respondent did not offer him an extension of his contract further to the expiry of the 11-month contract that he had initially been engaged on. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing to give evidence in relation to his complaint. |
Summary of Respondent’s Case:
As the Complainant did not attend the hearing to give evidence in relation to his complaint, the Respondent did not present any evidence. |
Findings and Conclusions:
As the Complainant did not attend the hearing to give evidence in relation to his complaint, I find that he has failed to establish a prima facie case of discrimination. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I find that the Complainant has failed to establish a prima facie case of discrimination for the reasons set out above. |
