Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
A complaint was received by the Director General of the Workplace Relations Commission by the Complainant on June 15 th 2021 alleging that his (now) former employer contravened the provisions of the Payment of Wages Act 1991 in relation to him. The said complaint was referred to me for investigation. A Hearing for that purpose was held on March 20th 2024. There was no appearance by or on behalf of the Complainant at the Hearing. The Respondent attended the Hearing. The Complainant was contacted by the WRC Concierge when he did attend the Hearing and he advised the Concierge that he was at work and would not be attending the Hearing. No advance notice of this situation was provided by the Complainant to the WRC. The Complainant advised the Concierge he could not attend the Hearing for even a moment to explain his situation or to request an adjournment. The Complainant was given the opportunity, by the Adjudicator, after the Hearing to request a new Hearing and the Complainant did not reply within the period specified. I am satisfied that the said Complainant was informed in writing of the date, time and place at which the Hearing to investigate the complaint would be held and were not present at the Hearing. I find the complaint not well founded. |
