Procedure:
In accordance with section 41 of the Workplace Relations Act 2015 and/or section 8 of the Unfair Dismissals Acts 1977 - 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the Parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
On 17 October 2023, the Complainant filed his Complaint Form with the Workplace Relations Commission (the “WRC”), in which he alleged that he was unfairly dismissed. The Complainant sought adjudication under section 8 of the Unfair Dismissals Act 1977-2015, as amended.
A remote Hearing was scheduled for 14 February 2024. Neither Party attended. |

Findings and Conclusions:
On 23 January 2024, the Parties were notified of the remote Hearing arrangements by the WRC. The same letter also set out the procedure regarding postponement requests. Neither Party requested a postponement. Having reviewed the file, I am satisfied that both Parties were on notice of the Hearing. The Complainant failed to attend the Hearing and failed to present any evidence in support of his complaint. In the circumstances, I find that the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
For the reasons outlined above, I find that this complaint is not well founded. |
