Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and S.I. 359/2020, which designated the WRC as a body empowered to hold remote hearings.
Although I am satisfied that the Complainant was on notice of the time and date of the hearing, she did not attend to give evidence. The Respondent was in attendance.
Background:
In her complaint submitted to the WRC on 07/11/2023, the Complainant stated that she was underpaid in respect of her final salary payment from the Respondent. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing to give evidence in relation to her complaint. |
Summary of Respondent’s Case:
As the Complainant did not attend the hearing to give evidence in relation to her complaint, the Respondent did not present any evidence. |
Findings and Conclusions:
As the Complainant did not attend the hearing to give evidence in relation to her complaint, I find that the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the complaint is not well founded for the reasons set out above. |
