Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 79 of theEmployment Equality Acts, 1998 - 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complaint, received on 27th November 2023 is that the complainant was discriminated against when he was harassed during his placement in a Golf Club.
Summary of Complainant’s Case:
The complainant was employed on a community employment scheme from May 2022 to October 2022 when he had to leave the post due to harassment by one of the employees of the Golf Club in which he was placed.
Summary of Respondent’s Case:
The Respondent understands that the Complainant withdrew his complaint at the time. A letter from the Golf Club confirming this was submitted. The Respondent is sorry the complainant felt he was treated badly and did make some efforts to place him in another scheme.
Findings and Conclusions:
The complaint was received on 27th November 2023, over a year after the complainant ceased working in the particular scheme. As the complaint is out of time, I do not find it to be well founded.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is out of time and is not well founded.
