Workplace Relations Commission Adjudication Officer: Michael MacNamee
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015,following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Complainant initiated the above complaints which were listed for adjudication hearing at the offices of the Workplace Relations Commission. There was no appearance by or on behalf of the Complainant. |
Summary of Complainant’s Case:
There was no appearance at the adjudication hearing by or on behalf of the Complainant. |
Summary of Respondent’s Case:
The Respondent was represented by Mr. Geoffrey Doyle, Operations Director and Mr. Colm Mulholland, Senior Operations Manager. The Complaints were contested. The Respondent was in a position to proceed. |
Findings and Conclusions:
There was no appearance by or on behalf of the Complainant at the adjudication hearing. Being satisfied that the Complainant had been duly notified of the time, date and venue for the adjudication hearing, I proceeded in the absence of the Complainant. The Respondent was present and ready to proceed and contested the claims in full. There being no appearance by or on behalf of the Complainant, the Respondent has no case to answer and the claims are not well-founded and I so find. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
