Procedure:

These complaints were submitted to the WRC on September 20th 2023 and, in accordance with section 41 of the Workplace Relations Act 2015 and section 39 of the Redundancy Payments Acts 1967 – 2014, they were assigned to me by the Director General. A hearing was arranged for Monday, April 22nd 2024 at 9.30am, for the parties to present evidence in respect of the complaints; however, neither the complainant or the respondent attended at the appointed time. Having checked the case file, I established that both parties were properly on notice of the hearing. By 10.00am, when neither party was present, and, with no contact regarding an explanation for not attending, I reached the decision set out below.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.

In the circumstances in which the complainant and the respondent did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that these complaints are not well founded and I decide accordingly.
