Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complain and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
This matter initially came before me on the 9th of February 2024. The Complainant represented himself but there was no appearance by or on behalf of the Respondent. The Hearing was adjourned to facilitate the Complainant so that he could double-check that he had identified the correct address and title for the Respondent. The matter was re-listed before me on the 14th of June 2024. On that date there was no appearance by or on behalf of either party. I was satisfied that hearing notifications had been sent to both parties at the addresses provided.
On both of the above occasions I conducted a remote hearing in accordance with the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and Statutory Instrument 359/2020 which designates the Workplace Relations Commission as a body empowered to hold remote hearings.

Findings and Conclusions:
There was no appearance by or on behalf of either party at the adjudication hearing on the 14th of June 2024. Both parties were notified of the hearing date arrangements. The Complainant being absent the Respondent has no case to answer. The Complaint is not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
