Procedure:

In accordance with Section 8 of the Unfair Dismissals Acts, 1977 – 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complaint Form was received from the Complainant on 7 April 2024. It was his complaint that he was unfairly dismissed from his employment with the Respondent.

Two witnesses appeared on behalf of the Respondent.

Summary of Complainant’s Case:

The Complainant had been in contact with the Workplace Relations Commission in the days before the hearing. Attempts were made to contact him again on the day of the hearing but there was no answer from his phone.

After waiting a reasonable period of time, there was no appearance by the Complainant.

Summary of Respondent’s Case:

The Respondent attended at the hearing and filed a submission.

Findings and Conclusions:

There is no doubt that the Complainant was on notice of hearing due to his contact with the Workplace Relations Commission in advance of the hearing.

Decision:

Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.

I find the Complainant was not unfairly dismissed where he did not attend to present his complaint at the hearing.
