Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant attended the hearing and confirmed his starting dates and termination dates as June 30th and September 1st respectively in 2022. |
Summary of Respondent’s Case:
The respondent did not attend the hearing but had submitted correspondence drawling attention to the fact that the complainant’s service was insufficient to bring him within the eligibility period to qualify for payment of notice. |
Findings and Conclusions:
The complainant confirmed at the hearing that the duration of his employment was from June 30th, 2022, to September 1st, 2022. He accepted that this was a period which did not bring him within the thirteen weeks qualifying period for the Min8imum Notice and Terms of Employment Act and I find accordingly. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons set out above complaint CA-00054604-001 is not well founded. |
