Date of Hearing: 30/10/2024
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present any information relevant to the dispute.
Background:
The worker submitted a complaint seeking a recommendation on two disputes under section 13 of the Industrial Relations Act 1969 which was received by the WRC on 1st November 2023. The first dispute is that she was unfairly dismissed. The second dispute is that the bullying and harassment procedures were not complied with by the employer. |
Summary of Workers Case:
The worker did not attend the hearing. |
Summary of Employer’s Case:
The employer consented for the dispute to be the subject of a recommendation from the Workplace Relations Commission (WRC). The hearing was attended by representatives of the employer. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties. As the worker did not attend the hearing to outline her unfair dismissal dispute, I recommend the worker accepts there is no valid dispute with her former employer.
As the worker did not attend the hearing to outline the non-compliance with bullying and harassment procedures, I recommend the worker accepts that there is no valid dispute with her former employer.
