Workplace Relations Commission Adjudication Officer: Peter O'Brien
Date of Hearing: 31/10/2024
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The Worker is a Lecturer and had a dispute regarding a competition for promotion to Professor. |
Summary of Workers Case:
The Worker set out her case in detail in a parallel employment legislation case and advised that the information provided in that case formed the basis of her industrial relations dispute. |
Summary of Employer’s Case:
The Employer set out in detail its reply to the dispute in a parallel employment legislation case and advised that the information provided in that case formed the basis of their response. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
Both parties relied on written submissions in a parallel employment legislation case and made no oral submission on the trade dispute. Both parties advised the decision in the parallel employment legislation case could be reflected as a Recommendation in this dispute.
|
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
Having considered the circumstances of this dispute and parallel complaint I find in favour of the Employer. |
