Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The complaint is that the Respondent failed to pay to the Complainant wages due to her.

Summary of Complainant’s Case:

The Complainant was employed by the Respondent from 12 May 2012 to 9 May 2022.  On 30 May 2022 she was provided with a payslip which confirmed that the net sum of €2,051.64 was due to be paid to her for accrued holiday and public holiday pay.   This sum was not paid to her.

Summary of Respondent’s Case:

The Respondent did not attend the hearing.

Findings and Conclusions:

The Complainant provided the payslip dated 30 May 2022 as proof that the sum of money claimed for unpaid wages was due to be paid to her.  She confirmed this sum was not paid.  Correspondence on file from the Respondent indicated that she does not contest the amount.

Based on this and the information provided by the Complainant, I find the complaint to be well founded.  I conclude that the amount of €2,051.62 should be paid to the Complainant by the Respondent.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

I have decided that the complaint is well founded, and I require the Respondent to pay to the Complainant the sum of €2,051.62.
