Procedure:
In accordance with section 39 of the Redundancy Payments Acts 1967-2014, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the Parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submitted a claim under Section 39 of the Redundancy Payments Act, 1967 on the 4th of April 2023.
A Hearing was held on the 22nd of January 2024. There was no appearance by or on behalf of the Complainant at the time the adjudication hearing was scheduled to commence.
I verified that the Complainant had been served with notice of the time, date, and venue of the adjudication hearing. I waited some time to accommodate a late arrival. There was no appearance by the Complainant. The Complainant did not contact the WRC to indicate any difficulty with attending the hearing.

Findings and Conclusions:
On review of the correspondence on file I am satisfied that the Complainant was notified of the hearing date, time, and venue. The complainant failed to attend the hearing to pursue his case. In the circumstances I am satisfied that the complaint should fail and accordingly I declare this claim to be not well-founded. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
As the Complainant did not attend at the hearing, I declare this claim to be not well founded. |
