Workplace Relations Commission Adjudication Officer: Breiffni O'Neill
Procedure:
In accordance Section 25 of the Equal Status Act, 2000,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Although I am satisfied that the Complainant was aware of the time and the date of the hearing, she did not attend on the day. The Respondent attended remotely as did his legal representative.
Background:
The Complainant stated in her complaint form that the Respondent discriminated against her when he refused to sign a HAP form that she gave to him. |
Summary of Complainant’s Case:
The Complainant did not attend on the day of the hearing to give evidence. |
Summary of Respondent’s Case:
As the Complainant did not attend on the day of the hearing to give evidence, the Respondent did not give any evidence. |
Findings and Conclusions:
As the Complainant did not attend on the day of the hearing to give evidence, I find that the Respondent did not engage in prohibited conduct. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
I find that the Respondent did not engage in prohibited conduct for the reasons set out above. |
