Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complaint was submitted to the Workplace Relations Commission (WRC) on 20th July 2023 and relates to unpaid wages in the amount of €400.00. |
Summary of Complainant’s Case:
The complainant stated in her oral submission that the respondent failed to pay her in respect of wages that were due to her for the month of February 2023 which equated to €400. The complainant stated that her employment ended on 28th February 2023, and she has still not received the payment due to her. |
Summary of Respondent’s Case:
The respondent did not attend the adjudication hearing and was not represented. The respondent emailed the WRC the evening before the adjudication to say that due to working full time, she was not able to attend the adjudication hearing. The respondent outlined that she had instructed her accountant to pay the outstanding wages to the complainant and was awaiting her bank account details so that payment could be made. |
Findings and Conclusions:
I note that the respondent first emailed the WRC on 19th November 2023 stating that the matter had been settled. The complainant stated that this was not the case in an email response on 27th November 2023. In respect of the adjudication hearing, the respondent sent an email to the WRC at 18.01pm the evening before the hearing confirming that she would not be in attendance. The respondent did not dispute that the payment was owed to the complainant and stated that she had instructed her accountant to make the payment. The respondent’s email was not received by the adjudication officer prior to the hearing taking place and the hearing proceeded on the basis of the complainant’s oral submission on the issue. In all of the circumstances of the complaint, I find that the complainant is due to be paid €400.00 by the respondent. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Having considered the oral submission of the complainant, I find the complaint is well founded. The respondent is directed to pay the complainant €400 in respect of unpaid wages due for February 2023. |
