Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
At the first hearing day the Complainant requested that an interpreter assist in the communication of his complaint. The hearing was adjourned to facilitate that request.
On reconvening for the second day with an interpreter the Complainant failed to attend. |

Findings and Conclusions:
The Complainant consented to email communication. Using the exact same email as on the first day of hearing when the Complainant was in attendance, he was again properly notified of the new hearing date on the 15th of December 2023. I am satisfied that the Complainant was properly notified of the date, place and time of the hearing and failed to attend. In these circumstances I must dismiss the complaint for failure to attend. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complaint is not well founded. The Complainant consented to email communication. Using the exact same email as on the first day of hearing when the Complainant was in attendance, he was again properly notified of the new hearing date on the 15th of December 2023. I am satisfied that the Complainant was properly notified of the date, place and time of the hearing and failed to attend. In these circumstances I must dismiss the complaint for failure to attend. |
